Mr.Saxena learned counsel for the appellant on instructions and in pursuance of a letter dated 5.12.2016 received by him from the Advocate for respondent no.1 which is taken on record and marked 'X' for identification, seeks leave to withdraw this Appeal, as it is stated that the decree passed by the Bombay City Civil Court in Suit No.10162 of 1988 stands satisfied as the respondents have accepted Rs.3,94,306.39 in full and final settlement. 3.

Accordingly, Appeal is allowed to be withdrawn and is dismissed as such. Civil Application No.3727 of 2014 does not
