This is second bail application filed by the applicant in connection with C.R. No.I-178 of 2019 registered with Uran Police Station for offences punishable under sections 302, 326 of the Indian Penal Code, 1860.

This Court by order dated 4th January 2021 rejected bail application after considering merits of the matter. 3.

According to learned advocate for the applicant, till today charges are not framed against the applicant and, therefore, applicant deserves to be released on bail on the ground of delay in trial.

It appears that the applicant was arrested on 18th November

17-ba4111-2021.doc 2019. Rejection of order of this Court is dated 4th January 2021. Offences alleged against the applicant are under sections 302 and 326 of the Indian Penal Code, 1860. The punishment for alleged offences is life imprisonment. Merely because charges are not framed, in the facts of the present case and considering reasons in order dated 4th January 2021, cannot be a ground to release the applicant in absence of material change in circumstance. 5.

The bail application is, therefore, rejected. (AMIT BORKAR, J.)
