Heard the learned Counsel for the Applicant, learned Counsel for Respondent - Insurance Company and the learned Counsel for Respondent No.2-Navi Mumbai Municipal Transport. 2.

By this application, the Applicant (Orig.Respondent No.1 in Appeal) is praying for withdrawal of decreetal amount granted by the Motor Accident Claims Tribunal which stands deposited before the

PVR 2/2 926caf4643-16.doc Tribunal as ordered in Judgment and award dated 14 July 2015 in MACP No.536 of 2009.

Considering the averments as made in Civil Application as also considering the impugned judgment and order, it would be in the interest of justice, that the Appellant is permitted to withdraw the decreetal amount of Rs.1,18,000/- alongwith the accrued interest subject to usual undertaking. The undertaking be filed within a period of four weeks from today.

Civil Application is accordingly disposed of in the above terms. No costs.
