Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application at the cost and consequences of the applicant. Hence, following order:

"(a) That this Hon'ble Court be pleased to pass necessary directions to delete the name of the Respondent no.2 from the Civil Applications and proposed Appeal."

C) Civil application stands disposed off accordingly.
