29th MARCH 2016.
P.C. :
Heard Shri Satyavrat Joshi, the learned counsel for the applicant. Heard Smt.P.P.Bhosale, the learned APP for the State. I have gone through the evidence of the victim and that of PW2 Rohan.
avk 1/3
A number of contentions have been advanced by the learned counsel for the applicant, including the contention that the medical evidence does not support the version of the victim. After carefully considering the matter from all the angles, I am of the opinion that this is not a fit case, where the substantive sentence imposed upon the applicant / appellant should be suspended during the pendency of the appeal. However, it would be proper in the circumstance, to expedite the hearing of the appeal.
Record and Proceedings with paper book have been received.
The application is rejected.
However, the hearing of the appeal is ordered to be expedited.
avk 2/3
The appeal be listed for Final Hearing on 2nd April 2016.
