The Applicant is accused in the Criminal Case No. PW/4003466/2016 pending on the file of Metropolitan Magistrate, 40th Court, Girgaon, Mumbai.

By order dated 20 September 2021, the learned Magistrate issued Non-Bailable Warrant against the present Applicant, which is impugned in the present application.

This court by order dated 16 December 2021 has stayed the order impugned.

The learned counsel for the Applicant submits that nonappearance before the trial court was not deliberate and the Applicant is ready and willing to appear before the trial court on the next date.

In view of the above statement, the orders impugned are quashed. The Applicant shall appear before the trial court on next date and shall not seek unnecessary exemptions/adjournments. 6.
