The learned counsel for the Petitioner submits that by mistake he filed the present Writ Petition instead of Application under section 24 of the Code of Civil Procedure, 1908. He submits that Petitioner may be permitted to withdraw the present Writ Petition with liberty to file appropriate proceeding under section 24 of the Code of Civil Procedure, 1908. To that effect, he has given in writing. Same is taken on record and marked "X" for its identification. Same is accepted.
