Heard Mr. Pravin Dabade, learned counsel for the petitioner and Mr. Mandar Limaye, learned counsel for respondent No.1.

Mr. Dabade states that the petitioner Narender Singh Kalyan Singh Bhatia is present in the Court today. He has tendered a photo-copy of his PAN card, which is taken on record and marked 'X' for 1 / 2
2 908.CP.540-13 identification. Upon taking instructions from him, Mr. Dabade seeks permission to withdraw this Contempt Petition. 3.
Mr. Limaye states that by order dated 12.8.2015, this Court directed respondent No.1 to deposit Rs.50,000/- in this Court. Mr.Limaye states that the petitioner has not withdrawn said amount and as such as respondent No.1 may be permitted to withdraw said amount of Rs.50,000/-.

In view thereof, on the motion made by Mr. Dabade, Contempt Petition is allowed to be withdrawn and is dismissed as withdrawn. Respondent No.1 is permitted to withdraw Rs.50,000/- unconditionally. In view of dismissal of Contempt Petition, Civil Application No.21/2017 filed by respondent No.1 praying extension of time by a period of four weeks' for obtaining permission as ordered by this Court vide order dated 18.1.2017 does not survive and the same is disposed of. Order accordingly.
