The office note indicates that the notice issued to the heir of the Respondent No.2 was pasted on the outer door of the premises wherein he is residing. It seems that the heir i.e. the Respondent No.2(a) had addressed a letter to the Learned Registrar of this Court which has been received on 21-32017 at 4.45p.m. by the office of the Learned Registrar of this Court. Hence the heir is very much aware of the above Civil Application as in the title of the said letter the number of the said Civil Application is mentioned. Since the date of the death of the Respondent No.2 is not known to the Applicant, it would have to be presumed that there is no delay in filing the above Civil Application. The Civil Application is accordingly allowed, the heir of the Respondent No.2 i.e. the Respondent No.2(a) is allowed to be brought on mmj
