Heard. The learned counsel for the Applicant submits that there is change of address of the Respondent i.e. present correct address as stated in the Civil Application. He submits that the Registry may be directed to issue fresh notice to the Respondent in the First Appeal on the present correct address.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, we are satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) The Registry is directed to issue fresh notice to the Respondent at his present correct address in the First Appeal, returnable after eight weeks. b) In addition to usual mode of service, the Applicant is permitted to serve the Respondent along with entire proceedings by way of private notice either by RPAD and/or by hand delivery and to file an Affidavit of service to that effect within eight weeks from today.

c) Civil application stands disposed off accordingly.
