On the Civil Applications for condonation of delay of 40 days being allowed by an order passed today, the above Review Petitions are taken up for hearing.
By the above Review Petitions, review is sought of the common order dated 6-8-2015 passed in the above Writ Petitions. The said order was passed by the consent of the parties whereby the impugned orders passed by the Maharashtra Revenue Tribunal were set aside and the matters were mmj
rpw-28378 & 28376-15-(901-902) remanded back to the Maharashtra Revenue Tribunal for a denovo consideration of the Revision Applications arising out of the orders passed by the Sub Divisional Officer. The Maharashtra Revenue Tribunal on remand was directed to decide the Revision Applications on their own merits and in accordance with law. Pursuant to the remand order, the Review Petitions were listed before the Maharashtra Revenue Tribunal and heard on 6th October 2015 as evidenced by the order passed by the Maharashtra Revenue Tribunal on the said day (Exhibit C to the Review Petitions). However it is thereafter that the instant Review Petitions have been filed.
Having perused the grounds for review and having heard the learned Counsel for the Petitioner and having regard to the fact that the order dated 6-8-2015 was passed by the consent of the parties, no case for review under any of the eventualities mentioned in Order 47 of the Civil Procedure Code is made out.
