This is an application under Section 439 of Code of Criminal Procedure for bail.

The applicant came to be arrested in Crime No. 189 of 2022 registered at Saswad Police Station, District Pune, for the ofences punishable under Sections 406, 420, 465, 471, 170, 171 read with 34 of the Indian Penal Code (IPC).

I have heard the learned counsel for the applicant and the learned APP for the respondent - State.

According to the prosecution, the present applicant and other co-accused had duped the complainant and witnesses to the tune of Rs.1,72,58,000, on the pretext that they would get them appointed in Forest Department.

The applicant is aged about Seventy (70) years and is in jail for about one year. Learned APP has tendered a report. The same is taken on record and marked "X" for the purpose of identifcation. Prima facie, the present applicant does not appear to be the benefciary of the amount in question. In that view of the matter and as there are no other criminal antecedents, I am inclined to release the applicant on bail. In the result, the following order passed.

O R D E R

A] Application is allowed.

B] The applicant- Ajit Gulab Chavan, be released on bail in C.R. No. 189 of 2022 registered at Saswad Police Station, District Pune, for the ofences punishable under Sections 406, 420, 465, 471, 170, 171 read with 34 of the IPC, on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
