The learned A.G.P on instruction states that as Tahsildar, Pune City has issued notice for fresh hearing on the representation of the Petitioner, the order dated 5th September, 2018 (Exhibit "K" to the Petition) will be withdrawn. We accept the said statement.

The learned counsel for the Petitioner submit that the Collector be directed to issue instruction for placing the representation before another Tahsildar. It is for the Petitioner to make such application to the District Collector who shall decide the same in accordance with law. 4.

In view of the withdrawal of the order and subject to what is observed by us, the Petition is disposed of.
