The above Civil Application has been filed for restoration of First Appeal which has stood dismissed for non-prosecution on account of the fact that the private paper book was not filed by the Appellant. The Appellant is the Union of India through the Central Railway. Hence, by accepting the reasons mentioned in the Civil Application, the same is allowed. Resultantly, the First Appeal is restored to file. The private paper book to be filed within eight weeks from date. Liberty to apply for hearing after private paper book is filed.
