Heard learned counsel appearing for the Applicant and the learned APP for the first Respondent. In view of the averments made in the Application, a case for restoration is made out. Accordingly, the Application is allowed in terms of prayer Clause (b) which reads thus:

"(b) This Hon'ble Court be pleased to quash and set aside the order dated 05/07/2016 passed by this Hon'ble Court and restored the Criminal Application No.420/2016 in its original file."

If a spare copy is not furnished within a period of four weeks from today, the order of dismissal dated 5th July 2016 will stand. If a spare copy is furnished within the stipulated time, notice be issued to the second Respondent in the Criminal Application No.420 of 2016, returnable on 22nd December 2016.
