This matter was mentioned on the earlier occasion and it is stated that against the order dated 8th July, 2017 of the Chairman and reviewing authority of the Mumbai Port Trust, the petitioner has preferred an appeal. The appeal is preferred to the second respondent. That appeal is pending since 14th September, 2017. Respondent no. 2-Union of India is duly served, but none appears on its behalf.

Let an affidavit proving service be filed within a period of one week from today.

After hearing both sides, we dispose of this writ petition by a direction to the appellate authority that the appeal pending before it shall be disposed of as expeditiously as possible and within a period of three months from the date of communication of this order.

We clarify that we have not expressed any opinion on the rival contentions nor have we concluded anything with regard to the guilt of the petitioner.
