Pursuant to the order dated 16th September, 2015, affidavit is filed by the respondent/contemnor in respect of Diwali and Christmas vacation. The affidavit is taken on record and marked 'X' for identification.

As per the affidavit, Diwali vacation of the child starts from 9th November, 2015 till 23rd November, 2015 and there is only one day holiday for Christmas, i.e. 25th December, 2015. Considering the observations made at the time of interviewing the child on 3rd September, 2015, the following order is found appropriate : (i) The custody of the girl child is to be handed over on 8th November, 2015 either to the grandfather, maternal uncle, maternal aunt or

mother of the child. They can take the child on 8th November, 2015 in the afternoon from her father's residence, i.e., 3B, Aarati CHS Ltd., Near Kalika Mandir, Shrihari Kute Marg, Bombay Naka, Nashik. The child shall stay at Mumbai in her grandmother's house from 8th November, 2015 till 13th November, 2015. The child shall not be shifted from Mumbai. On 14th November, 2015 the child is to be brought back to her father's residence at Nashik between 2 p.m. to 4 p.m.

(ii) As there is only one day holiday on 25th December, 2015 for Christmas, the custody of the girl child will not be handed over. 3.

In view of this, Contempt Petition is disposed of. (MRS.MRIDULA BHATKAR, J.)
