Heard. This is an application under Section 438 of Cr.P.C. The applicant herein is arrested in Crime No.161 of 2016 registered at Gangapur Police Station, Dist. Nasik for the offences punishable under Sections 420, 406, 409, 468, 471,120B of the Indian Penal Code and Sections 3 and 4 of MPID Act.

After arguing for some time, the learned counsel for the applicant, upon instructions, seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice. The learned counsel for the applicant submits that the applicant would surrender before
Mhi 2 ABA-1799-16.sxw the learned Special Court, Gangapur. The applicant shall appear before the Special Court on or before 13.12.2016. The learned Special Court shall consider the application of the applicant under Section 437 of Cr.P.C. without being influenced by the fact that the application under Section 438 of Cr.P.C. has been withdrawn as the parameters for grant of bail under Sections 437 and 438 of Cr.P.C. would be different. The learned Special Court is also requested to make an endeavour to decide the application of the applicant on the same day when he appears before the Court. 3.
