Heard. By this Civil Application, the Applicant is seeking to recall the order dated 07.10.2013 passed by this court (Coram : Anoop V. Mohta, J., as he then was).

On the other hand, the learned counsel for the Respondent submits that in the present proceedings the Appellant challenges the order dated 12.04.2010 passed by the learned Judge, City Civil Court, Mumbai, at Dindoshi in Notice of Basavraj G Patil 1/2

45.344.18-caa.doc Motion No.1007/2010 in S.C. Suit NO.657/2010.

He submits that the Appellant has withdrawn the suit NO.657/2010. In support of this statement, he has placed on record a photocopy of order dated 17.01.2015 passed by the Trial Court. Same is taken on record and marked "X" for identification.

In view of subsequent development and as the suit itself is withdrawn, nothing survives in the Civil Application.

The Civil Application stands disposed of as withdrawn.
