The petitioners have approached this Court praying for two reliefs, first-one challenging the demand notice issued on 10/08/2015 for payment of local body tax and second-one is for direction to the Corporation to sanction the plans of the petitioners for construction at Ulhasnagar.

Insofar as the first issue is concerned, Mr.Patil - learned Counsel appearing on behalf of the Corporation states that the impugned demand notice has already been withdrawn, as such 1/2

11. wp 10419.15.doc insofar as the said prayer clause is concerned, the purpose is served. 3.

Insofar as the second grievance regarding the sanction of the plans is concerned, we do not find it will be appropriate for us to issue a direction in that regard.

The Petition is, therefore, rejected insofar as second prayer clause is concerned reserving the rights of the petitioners to take such steps as are permissible in law in that regard. (M.S.KARNIK, J.) (B.R.GAVAI, J.) 2/2
