Heard learned Counsel for the applicant.

Learned A.P.P, at the outset, points out that the present application has been filed against the order dated 14th October, 2015 refusing interim protection to the applicant. He states that the matter is kept on 23rd October, 2015 for deciding the main application. 3.

Considering that the matter is kept on 23rd October, 2015, it would be appropriate to direct the learned Sessions Judge, Pune to decide the said application on 23rd October, 2015 itself, since no interim protection has been granted to the applicant.

In view of the aforesaid direction, the learned Counsel for the applicant does not press this application and seeks leave to withdraw the application.

Accordingly, application is disposed of as withdrawn. 6.

It is made clear that this application has not been considered on merits and the learned Sessions Judge to hear and decide the main application on 23rd October, 2015 on its own merits uninfluenced by the withdrawal of this application.
