P.C. :- 1] This Revision Application challenges the order dated 17 November 2009, by which the election of the petitioner has Councilor from Ward No.3 was set aside.
2] This Revision Application was admitted on 16 December 2009 and ad-interim relief was granted in terms of prayer clause (c) staying the impugned order dated 17 November 2009. 3] From the circumstance that none appear for the applicant and respondents, it is reasonable to presume that the term for which the applicant was elected as a Councilor some time in the year 2007 may have since expired.
4] Accordingly, present revision application is disposed of as having been rendered infructuous. The disposal of this Revision Application as infructuous may not be construed as affirmance, on the question of law decided in the impugned order dated 17 November 2009. Accordingly, the said question of law is kept open for decision in an appropriate case.
