If the hostel is being operated by the institution for accommodating girl student, the petitioner could not have been appointed to the post of superintendent in view of the policy prescribed by the State Government. Prima facie, for aforesaid reason the order impugned in the petition needs to be upheld.

In the affidavit in reply presented on behalf of the State it is recorded that the appointment of the petitioner is contrary to the policy decision of the Government recorded in resolution dated 14/1/2011. In view of policy adopted by the State Government the post of superintendent of girls hostel if occupied by male superintendent and when become vacant shall stand abolished and the Institution shall be restrained from appointing superintendent other than female superintendent.
