None present for the applicant. The applicant herein is arrested on 21st June, 2016 in C. R. No.12 of 2008 for offences punishable under Sections 255, 260, 465, 467, 468, 471, 419, 420 read with 120-B of Indian Penal Code.

It is a matter of record that the present application was filed on 14th October, 2016. None appears for the applicant on 17th January, 2017. This Court issued notice to the State to take instructions. 3.

Today also none appears for the applicant. Learned APP upon instructions submits that during the pendency of this application, the applicant had approached the Sessions Court and filed an application under Section 439 of Criminal Procedure Code on 18th January, 2017.

When the applicant was taken to Court on 17th January, 2017, the applicant has filed the application, before Sessions Court seeking enlargement on bail. There is no reference to the pendency of present application. Hence, the application stands dismissed for want of prosecution.
