Though the learned counsel for the applicant advances a number of arguments and contends, primarily, that since the co-accused Anand @ Andy Cruz has now been released on bail, the applicant is also entitled to be released on bail. He, however, admits the claim of the investigating agency / prosecution that the applicant, after his arrest, had absconded from the hospital, where he was kept by the police. The applicant was later on arrested by Vashi Police Station. The fact that the applicant has absconded from police custody is, thus, not disputed by the learned counsel for the appellant.

In view of this conduct of the applicant, I do not think it fit to release the applicant on bail.

On the prayer of the learned counsel for the applicant, however, the trial is directed to be expedited. The application is rejected.

However, the trial court shall expedite the trial and endeavour to complete it within a period of six months from the date of receipt of this order by it.
