Learned counsel for the applicant, on instructions, seeks leave to withdraw the present application.

The bail application is allowed to be withdrawn. 4.

It is submitted by learned counsel for the applicant that trial has been protracted at the instance of the prosecution as despite several opportunities granted to the prosecution, they have not placed on record the documents. Considering that the applicant is in custody for more than 4 years and as the charges have been framed by the trial Court, the trial Court is requested to expedite the trial. 1/2

In case, the trial does not progress substantially, liberty to apply for bail after 6 months or after the chemical analysis report is filed, whichever is earlier.
