This Court by an order dated 30 April, 2021 in Criminal Bail Application No.1282 of 2021 while releasing the applicant on bail directed him to deposit his passport with the Investigating Officer. 2.

The learned counsel for the applicant submits that the applicant is required to travel to Rwanda for the purpose of his business. It is submitted that this Court while releasing the applicant on bail has observed that the alleged relationship between the applicant and the prosecutrix was consensual. It is 1 / 3

submitted that the applicant after his return from Rwanda is ready to deposit the passport with the Investigating Officer. 3.

On the other hand, the learned APP for the State/respondent submits that considering the facts of the case, this Court has directed the applicant to deposit the passport with investigating officer. It is submitted that the request made by the present applicant, therefore, may not be considered.

The learned counsel for the applicant has placed on record a letter dated 26 September, 2022 addressed by ACME Earthmovers Limited to the applicant.

Perusal of the said letter shows that the applicant is asked to visit the office of ACME Earthmovers Limited for the purpose of demonstration of usage of the equipment which the applicant has exported to the said company situated at Gacuriro-Kigali Rwanda. 6.

Considering the above facts, the following order is passed:-

ORDER

(i) The applicant shall submit necessary travel details to the investigating officer. On submitting the travel details, the Investigating Officer shall return the passport to the applicant on an undertaking that he shall re-deposit the same after his return from 2 / 3

Rwanda.

(ii) Application is disposed of accordingly.
