This is an application for suspension of sentence and releasing the applicant/accused on bail during pendency of the appeal filed by him.

The applicant/accused has been convicted for the offences punishable under Sections 7 and 13(1) read with Section 13(2) of the Prevention of Corruption Act, 1988. On first count, he is sentenced to suffer simple imprisonment for six months and Gaikwad RD 1/2

(24)APPANo.16232018 on another count, he is sentenced to suffer simple imprisonment for two years. Some fine is also imposed on the applicant. Heard the learned Counsel appearing for the applicant/accused as well as the learned Additional Public Prosecutor for the respondent/State.

It is reported that during pendency of the trial, the applicant/accused was on bail. He has deposited the entire amount of fine. The learned trial Court has already released on him on bail after recording his conviction. It is also to be noted that the appeal filed by the applicant may not be heard within a short span of two years considering the pedency of appeals before this Court. Hence the Order

ORDER

(i) The application is allowed.

(ii) The substantive sentence of imprisonment imposed on the applicant/accused is suspended and he is directed to be released on bail on his executing P. R. Bond of Rs.15,000/­ and on furnishing surety in the like amount. (iii) The application is disposed of accordingly. (A.M.BADAR J.) Gaikwad RD 2/2
