Heard learned Counsel for the parties.

The learned counsel for the petitioner submits that they preferred application dated 30.10.2013 under Section 39(1) of the Maharashtra Village Panchayat Act, 1958 to remove Respondent No.1 as a Member of Gram Panchayat, Saradwadi, Taluka Shirur, Dist. Pune.

The learned counsel for the Respondent No.1 submits that in the meanwhile, the Respondent No.1 submitted his resignation and same was accepted by the Gram Panchayat. To that effect, he has placed on record a letter dated 21.04.2017 of Gram Panchayat to the Collector and Resolution passed by the Gram Panchayat. Same is taken on record and marked "X" for identification.
