The applicant seeking regular bail in Crime No. II-5 of 2016 registered on 25.01.2016 for the offences punishable under Sections 9, 39(a), 48(A), 49(B), 50, 51 of the Wild Life (Protection) Act, 1972. The applicants were found to be in possession of the nail of dead leopard. It is brought to the notice of the learned counsel for the applicants that main accused Mahadev Warghade is already released on bail vide order dated 07.09.2016.

The learned counsel for the applicants make a categorical statement that there are no criminal antecedents against the applicants. The charge sheet is already filed. Looking to the nature of punishment prescribed for the offence, in my opinion applicants deserves to be released on bail on furnishing P.R. Bond of Rs.25,000/- with one or two sureties in the like amount.

925.BA. 2138.16.doc The applicant shall regularly attend the trial and two consecutive defaults in attending the trial will entail the Court to proceed with cancellation of bail.

The applicant shall not tamper with the evidence or influence the witnesses.

In view thereof, the application is allowed.
