DATE : 30th OCTOBER, 2017.

P. C. :

Heard learned counsel and learned APP appearing for the respective parties.

2.

All these petitions arise out of externment proceedings. The petitioners were externed under Section 55 of Maharashtra Police Act for the period ranging from 1year to 2 years. The petitioners, being aggrieved, approached the appellate authority viz. the Divisional Commissioner, Pune Division, Pune under Section 60 of the Maharashtra Police Act by filing separate appeals. The petitioners also preferred Shubhada S Kadam 2/3

separate applications for interim stay before the appellate authority. These stay applications were rejected by passing separate order dated 16th September, 2017 in each of the applications and these orders are impugned in the present petitions.

3.

A statement is made across the Bar by the learned counsel appearing for the respective petitioners that the appeals filed by the petitioners before the appellate authority are heard finally and hearing is concluded on 24th October, 2017. This statement is not disputed by the learned APP for the State.

4.

In these circumstances, we are not inclined to entertain these petitions. Suffice it to direct the appellate authority viz. the Divisional Commissioner, Pune Division, Pune, to pass final order in the said appeals as expeditiously as possible and, in any case, within a period of two weeks from the date of receipt of this order. Ordered accordingly.

5.

In the light of the above, the petitions are disposed off. [DR. SHALINI PHANSALKAR-JOSHI, J.] [RANJIT MORE, J.] Shubhada S Kadam 3/3
