Mr. Pandey, the learned counsel appearing for respondent No.2 submitted that on 24.1.2017 the coordinate Bench (Smt. S. S. Jadhav, J.) heard two applications for cancellation of bail bearing No. 645/2016 and the present application i.e. No.611/2016. That, the coordinate Bench was pleased to allow Criminal Application No.645/2016 and was in fact pleased to dismiss the present application. However, the said fact is inadvertently not mentioned in the said order dated 24.1.2017. He submitted that according to him as of today the present application does not survive as the co-ordinate Bench has already dismissed the same on 24.1.2017. Mr. Mhatre appearing for the applicant did not support this contention.

Mr. Pandey therefore seeks liberty to move the same Bench for clarification and/or for speaking to the minutes of order dated 24.1.2017. At his request S.O. for 2weeks. (A.S.GADKARI, J.)
