The respondent no.3 has expired. All the legal heirs of the respondent no.3 are on record. Leave to amend is granted to delete the name of the respondent no.3. Amendment to be carried out forthwith. Re-verification is dispensed with.

There is delay of 217 days in filing the first appeal in aforesaid civil applications. No affidavit in reply is filed. Learned counsel appearing for the respondent nos. 1 and 2 (original applicant contesting parties) has no objection if the delay is condoned. Statement is accepted. Other respondents remained absent though served. Delay is sufficiently explained in the civil applications in paragraph (3). The reasons recorded therein are accepted. Delay of 217 days in filing first appeals is condoned as prayed. No order as to costs. 3.

Place all the first appeals on Supplementary Board on 22nd November,2019.
