Applicant is seeking his enlargement on bail in Crime No.668 of 2017 registered with Malvani Police Station for the ofences punishable under Sections 307, 324, 506(2), 323, 504 read with Section 34 of the Indian Penal Code, 1860.

Applicant is in custody since 9th September, 2017. Investigation is over and fnal report has been Shivgan 1/3

fled.

Submission is that once, the investigation is over, accused should not be detained in custody. Reliance is placed on the order of the Hon'ble Apex Court in the case of Bhausahb Nagu Dhavare v. State of Maharashtra and Anr. 2001(3) Crimes 410 (SC).

In present case, mother of the victim is eye witness. She alleged, applicant inficted abdominal stab injury on her son by knife. Medical report, corroborates this fact wherein nature of injury described as 'stab injury'' of 1x0.5x0.5 cm and categorised it as 'grievous injury'. Knife allegedly used was of size 14.5 x 3.5 x 11 inches, a dangerous weapon.

In view of the nature of accusation, kind of injury, statement of eyewitnesses and size of weapon (dangerous weapon), no case is made out for releasing the applicant on bail.

Applicant is in custody since September, 2017 and if the trial does not commence on or before 31st December, 2020, applicant may renew his request for enlargement on bail.

With the aforesaid observations, application is rejected and disposed of.
