This is an application seeking regular bail in Crime No. 73 of 2016 for the offences punishable under Section 302 of the Indian Penal Code.

The prosecution case is that the applicant and the deceased Aakash were close friends posted on a same toll booth as a bouncer. The differences ensued in between them. As a consequence both assaulted each other, in which Aakash lost his live resulting into registration of the crime. Investigation in the matter is already over. Charge-sheet is filed. There are no criminal antecedents. No weapon is used in the crime in question as the assault was by fists and blows. 3.

The case at the most could be considered under Section 304-A 1/2

(44) BA 2141-16 of the IPC for culpable homicide not amounting to murder. In view thereof, the case is made out for the bail.

The applicant is released on P.R. Bond of Rs.25,000/- with one or two sureties in the like amount. The applicant shall not tamper with the prosecution evidence and influence the witnesses. The applicant shall appear before the Trial Court regularly. The applicant's absence before the Trial Court would entail him for cancellation of bail. [N. W. SAMBRE, J.] 2/2
