The petitioner has approached this Court being aggrieved by the order dated 30th July 2013 passed by the Scheduled Tribe Certificate Scrutiny Committee, Nasik by which the services of the petitioner came to be terminated by the respondent No.2 on the ground of invalidation of the tribe claim of the petitioner, who claimed to belong to the Scheduled Tribe, viz., Hindu Mahadev Koli.
Upon perusal of the the order passed by the Scrutiny Committee dated 30th July 2013, it reveals that the Scrutiny Committee has taken into consideration all the relevant aspects and in addition it is also to be noted that the petitioner has not produced single preconstitutional document in Shraddha Talekar PS 1/2
21.wp.569.2014.doc support of his claim. Therefore, we are of the view that the orders passed by the Scrutiny Committee cannot be faulted with. Once the tribe claim was invalidated by the Scrutiny Committee, the respondent No.2 was left with no other option than to terminate the services of the petitioner in view of the guidelines laid down by the Apex Court in Chairman & Managing Director, FCI & Ors. Vs. Jagdish Balaram Bahira & Ors. 1. The petition stands disposed of.
