By this Writ Petition, the petitioner has challenged the action on the part of the respondent-election returning officer of rejecting the nomination papers of the petitioner.
The last date for submission of nomination papers was 29.09.2017 and the scrutiny of the nomination papers is concluded on 03.10.2017. Today, the election symbols would be allotted. In view of the law laid down by the Hon'ble Supreme Court and this Court in the judgments reported in 1978 (1) SCC 405, 1988 (1) SCC 277, (2004) 7 SCC 492 and (2010) 1 Mh.L.J. 909 it would not be proper to interfere with the election process at this stage. We dismiss the Writ Petition with no order as to costs. The points raised in the Writ Petition are kept open.
