In the present proceeding, the applicant party in person challenges the order dated 17.09.2014 passed by the District Judge, Thane in Misc. Application No. 271 of 2014 under Section 24 of Code of Civil Procedure, 1908 for transfer of Regular Civil Suit No. 2088 of 2012 from one Judge to another. That application was dismissed by the District Court. Hence, applicant has preferred the present Writ Petition.

The learned counsel for the respondent submits that the particular Judge is already transferred from the said Court. Hence, nothing Sneha Chavan 1/2

4 caw 2684-14=.doc survives in the present petition. She submits that petition became infructuous in view of subsequent development i.e. transfer of Judge. Statement of learned counsel for the respondent is accepted. In view of subsequent development, nothing survives in the Writ Petition.

Hence, Writ Petition as well as Civil Application stand dismissed as infructuous. No order as to costs.
