Heard Shri Aniket Nikam, the learned counsel for the applicant. Heard Smt.M.R.Tidke, the learned APP. The appeal filed by the applicant challenging the conviction and the sentence imposed upon him has already been admitted. By the present application, the learned counsel for the applicant prays that pending the hearing and final disposal of the avk 1/3

appeal, the substantive sentences imposed upon the applicant be suspended and he be released on bail.

The learned counsel submitted that the appellant has a good case on merits. He submitted that the medical evidence falsified the claim of the prosecutrix.

After carefully considering the matter, I do not think it fit to suspend the sentences imposed upon the applicant. The applicant can take steps to have the appeal expeditiously heard. In case of delay in the hearing and final disposal of the appeal, the applicant may renew his prayer for suspension of sentences. At this stage, I am not inclined to suspend the sentences.

The application is rejected.
