Though all the prayers in Suit No. 457 of 2005 have not been decided, the parties have filed consent terms seeking division of a plot as agreed by the parties under the family arrangement / registered Memorandum of Understanding dated 18.5.1998. Thereafter, the petitioner herein applied to the Area Manager, MIDC, Thane seeking sub-division of the plot as per the consent terms. By his letter dated 27.4.2017, the Area Manager, MIDC, Thane has informed the petitioner and others that since Suit No. 457 of 2005 is pending before this Court, all the papers pertaining to the subject matter are
1. civil wp 11675-18.doc pending in Court, therefore, the petitioner should forward a compilation of all the documents as well as a copy of the order passed by the Court in Suit No. 475 of 2005. Pursuant thereto, the petitioner under cover of her letter dated 6.9.2017 has forwarded necessary documents / orders to the Area Manager, MIDC, Thane. However till date, MIDC, Thane has not responded to the same and have not demarcated / sub-divided the said plot. In view thereof, the MIDC, Thane is directed to consider the application made by the petitioner seeking demarcation / sub-division of the plot and also the documents submitted under cover of her letter dated 6.9.2017 and pass appropriate orders within a period of three weeks from the receipt of a copy of this order. 2.
Writ Petition is accordingly disposed of.
