Mr. Sarda, the learned advocate appearing for the appellant concedes to the position that the First Appeal ought to have been filed in the District Court and seeks to withdraw the First Appeal. The same is allowed to be withdrawn with liberty to the appellant to file the appeal in appropriate court. In view of withdrawal of the First Appeal, the Civil Application does not survive. The same is accordingly disposed off.
