Mahindra Sona Ltd. and Ors.

... Respondents.

Ms. Ranjana Todankar for the Petitioners.

None for the Respondents.

CORAM : N.M. JAMDAR, J.

DATE : 11 JANUARY, 2016.

P.C. :- Heard the learned Counsel for the Petitioners. By order dated 31 July 2015, the Labour Court had granted interim relief in favour of the Petitioners protecting their services. Thereafter, in the revision filed by the Respondent No.1, the Industrial Court set aside the order of the Labour Court and remanded the proceedings to the Labour Court for deciding the application on merits. It is informed that the Petitioners are no longer in service. The Application for interim relief was taken out for protection of services. No interim protection existed after 16 September 2015.

WP 11956.15.sxw 2.

In the circumstances, it is not possible to grant any relief in favour of the Petitioners. In this petition the proceedings are remanded back to the Labour Court for deciding the application. It will be open to the Petitioners to agitate their grievance before the Labour Court where the matter is pending. Considering the fact that the Industrial Court has remanded back the matter at an interim stage and also keeping in mind the date of notification, the Labour Court will give appropriate priority to the same.

3.

Writ Petition is accordingly disposed of keeping all points on merits open.
