CORAM :

NITIN JAMDAR AND MANJUSHA DESHPANDE, JJ.

DATE :

11 OCTOBER 2023 P.C. :

By these Petitions, the Petitioners are seeking directions to Respondent No.4-Assistant Registrar to decide the representations filed by the Petitioners on 28 August 2023. All that, the representations state that the Petitioners be given benefit of section 44-(A) of the Maharashtra Co-operative Societies Act, 1960. 2.

Even though the cause is diverse, all representations are of 28 August 2023, the Petitions are filed on 12 September 2023 through the same Advocate within 14 days after the representations are made. The writ of mandamus is predicated on the basis that there is a failure on the part of the statutory authorities, which needs to be enforced. Not deciding the representations in 12 days cannot be considered as failure of the duty. Therefore, we are not inclined to issue a writ of mandamus in these Petitions. We deprecate such needless creation of litigations.

The Writ Petitions are accordingly disposed of. However, this does not mean that the representations should not be decided at all. They be decided within a reasonable period depending on other pressing public duties.
