2] Applicants are seeking pre-arrest bail in C.R. No. 0626 of 2021 registered with Mahatma Phule Police Station for the offence punishable under Section 420 r/w Section 34 of the IPC. 3] The case of the complainant is based on partnership deed dated 18th June, 2018 whereas the case of the Applicants/Accused is that of hand-loan.

4] The complainant has a remedy based on partnership deed of filing suit for taking accounts in which issue of existence of partnership can be gone into. The contractual dispute is sought to be given colour 1/2

911 ABA-3092-21.doc of offence. As such, case for pre-arrest bail is made out. 5] In the event of the arrest of the Applicants in C.R. No. 0626 of 2021 registered with Mahatma Phule Police Station for the offence punishable under Section 420 r/w Section 34 of the IPC, Applicants be released on bail on executing P.R. Bond in the sum of Rs 25,000/-each with one or more sureties in the like amount. Applicant shall attend the Investigating Officer of the concerned Police Station from 10th January, 2022 to 16th January, 2022 between 10.00 A.M. and 12.00 Noon and thereafter as and when directed.
