This Civil Application seeks a restraint upon the respondent from transferring, alienating or parting with possession of the suit premises pending hearing and final disposal of the application.

The respondent has handed in Affidavit in reply dated 22nd March 2017. In paragraph No.6 the allegations with regard to any attempts to create third party rights or parting with possession have been denied.

Further, a statement has been made in the said affidavit that Smt.Navina Shetty, the respondent, is in possession of the suit premises which is used for carrying out business along with her husband, Dinesh Shetty.

Mr.Godse, in any case submits that there is absolutely no intention to transfer, alienate and create any third party rights or part with the possession of the suit premises. 5.
In view of the aforesaid, the Civil Application is disposed of.
