This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No. 546 of 2021 registered at Sangli City Police Station, for the offence punishable under Sections 363, 366A, 376 of Indian Penal Code and Sections 4, 5 of the Protection of Children from Sexual Offences Act, 2012. 3.

I have heard the learned Counsel for the applicant and the learned APP for the State.

On the date of lodging of report, the prosecutrix was 17 years 8 months old. She on her own left the house of her parents. On 3 September 2021 the prosecutrix had even performed the marriage with the applicant in Mandir at Alandi. Considering these facts, I am inclined to release the applicant on bail. Hence, the following order is passed : (i) Application is allowed.

(ii) The applicant - Shubham Ravindra Kadam be released on bail in Crime No. 546 of 2021 registered at Sangli City Police Station, for the offence punishable under Sections 363, 366A, 376 of Indian Penal Code and Sections 4, 5 of the Protection of Children from Sexual Offences Act, 2012 on furnishing P.R. Bond in the sum of Rs.15,000/- with one surety in the like amount.
