The applicant was granted interim relief by an order dated 19.10.2016. The reasons for grant of interim relief are elaborately mentioned in the said order. The allegations against the applicant is that he being the Managing Director of M/s. Simplex Prefab Infrastructure (India) Ltd. Submitted forged documents to the Sales Tax Department and evaded tax. The record reveals that though the applicant is aged about 75 years and suffering from various age related ailments, he has attended the Investigating Officer and co-operated in the process of investigation. 2.

I have perused the record produced before me. As a matter of fact, after compliance of necessary formalities, the Tax Authority has now come to conclusion that the applicant is entitled for refund of tax amount. In view thereof, the applicant deserves to be granted pre-arrest 1/2

(14) ABA 1814-16 bail. The interim relief granted on 19.10.2016 is hereby confirmed. However the condition to attend the police station is hereby waived with immediate effect.
