Heard learned counsel for the applicant-appellant on this application for reduction of the bail amount. The bail is granted to the present applicant on 09th July 2015 (Coram:A.S. Gadkari, J). Bail amount is fixed at Rs.30,000/- with one or two solvent sureties in the like amount. Other conditions were imposed as to not enter the jurisdiction of Mumbai Municipal Corporation, except for attending the Special Case No.18 of 2013 pending in Sessions Court, Mumbai. Other conditions were also imposed to attend the Police Station once in a month. All these conditions are N.S. Kamble page 1 of 3
incorporated in the order of bail dated 09th July 2015. Said bail order was passed during the pendency of the appeal. In the appeal the challenges to the conviction of the appellant for the offence under section 307 of Indian Penal Code. He was convicted vide order dated 30th April 2015 for offence under section 307 of Indian Penal Code and sentenced to suffer SI for 10 years and to pay fine of Rs.10,000/-.

Reportedly apart from the present appeal bearing no.623/2015, there are two other cases pending against the present applicant and which are pending before the Sessions Court, Mumbai and Metropolitan Court, Kurla. Considering the punishment awarded and which is challenge in the appeal and considering the terms and conditions imposed on the applicant and considering the antecedent, in the considered view of this Court the quantum of bail amount is so fixed and as such it cannot be altered in any manner so as to reduce the said quantum as prayed to Rs.15,000/-. In the result the present application is dismissed and disposed of.

After passing of this order again the oral request is made on behalf of the applicant that instead of one or two solvent sureties for total amount of Rs.30,000/-, the said condition be relaxed by allowing the applicant to give one or more sureties. Said request is accepted. Instead of one or two sureties the applicant is entitled to give one or more sureties for total amount of Rs.30,000/-.
