By this petition under Articles 226 and 227 of the Constitution of India, the petitioner is challenging the order dated 28.8.2018 passed by the DRT-II, Mumbai in Securitisation Application No. 472 of 2018.

When this Court declined to entertain the present petition, the learned counsel for the petitioner submits that

8. civil wp 10874-18.doc the petitioner may be permitted to withdraw the present Writ Petition with liberty to file appropriate proceedings before the DRAT. He submits that the ad-interim protection granted by this Court by order dated 26.9.2018 be continued for one week. To that effect he has given in writing. The same is taken on record and marked "X" for identification. The same is accepted.

Writ Petition stands disposed of as withdrawn. 5.

Ad-interim protection granted by this Court by order dated 26.9.2018 to continue till 23.10.2018 only. 6.

All contentions of both the parties are kept open. 7.

The DRAT to decide the appeal if any filed by the petitioner without being influenced by the order passed by this Court.
