This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No. 171 of 2021 registered at Shahapur Police Station, for the offence punishable under Section 302 of Indian Penal Code.

I have heard the learned Counsel for the applicant and the learned APP for the State.

The deceased and present applicant were friends. The applicant had suspicion that his wife had illicit relation with the deceased and therefore according to the prosecution, he was annoyed with him. 5.

According to the prosecution, on the date of alleged incident, which took place on 11 June 2021, altercation took place between the present applicant and the deceased. It is alleged that during the said altercation, the present applicant assaulted the deceased by knife and committed his murder.

The incident prima facie does not appear to be premeditated. The applicant is in jail for more than 11⁄2 years. Considering the overall facts and circumstances of the case, I am inclined to release the applicant on bail. Hence, the following order is passed : (i) Application is allowed.

(ii) The applicant - Ajit @ Pintu Babu Admane be released on bail in Crime No. 171 of 2021 registered at Shahapur Police Station, for the offence punishable under Section 302 of Indian Penal Code on furnishing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount.
